Terms of Service

These Terms of Service ("Terms") govern your access to and use of AfterWurk ("Service"), operated by AfterWurk ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using AfterWurk, you confirm that you are at least 18 years of age, are an authorized employee of an organization that has deployed AfterWurk, and agree to these Terms and our Privacy Policy.

2. Description of Service

AfterWurk is a company-private employee bonding platform that enables employees to discover, create, and join voluntary after-work activities. The Service is deployed by companies ("Organizations") for use by their employees ("Users").

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at dylan@afterwork.com of any unauthorized use of your account.

You agree to provide accurate information when creating your account. Impersonating another person or providing false information is a violation of these Terms.

You agree to use AfterWurk only for lawful purposes and in accordance with these Terms. You agree not to:

5. Activities and Participation

Voluntary participation: All activities on AfterWurk are entirely voluntary. Users are under no obligation to participate in any activity.

Personal responsibility: Users participate in activities at their own risk. AfterWurk is not responsible for any injury, loss, or harm that may occur during or as a result of activities organized through the platform.

Activity organizers: If you organize an activity, you are responsible for ensuring it complies with applicable laws, your employer's policies, and these Terms. You must accurately represent the nature of the activity.

You retain ownership of content you post on AfterWurk. By posting content, you grant AfterWurk a non-exclusive, royalty-free license to display and store that content solely for the purpose of operating the Service.

You are solely responsible for the content you post. AfterWurk does not endorse any user-generated content and reserves the right to remove any content that violates these Terms.

7. Administrator Rights

Organizations that deploy AfterWurk designate HR administrators who have the authority to moderate activities, manage user accounts, and configure the platform. Administrators may remove content or deactivate accounts that violate these Terms or the Organization's policies.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AFTERWORK IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, OR DATA OF THIRD PARTIES, OR ANY ACTIVITIES OR EVENTS ORGANIZED THROUGH THE PLATFORM.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTERWORK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. Organizations may also deactivate employee accounts at their discretion. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Minnesota, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Minnesota.
